How do I sell an inherited home in Cape Coral?
To sell an inherited home in Cape Coral, someone first needs legal authority to sign the deed, usually a personal representative appointed through Florida probate, and then the home is priced and listed like any other Southwest Florida property. I'm Frank Glaab, P.A., a Realtor with Epique Realty in Cape Coral, and here is the general order of steps families follow.
Does an inherited Cape Coral home have to go through probate?
It depends on the title. The Florida Bar says real estate in the decedent's sole name, or held as tenants in common, is a probate asset unless it is homestead property. A home held as joint tenants with rights of survivorship is not, and a home owned by spouses as tenants by the entirety passes to the surviving spouse. Who can sign the listing and the deed?
The court appoints a personal representative (Florida's term for an executor) and issues "Letters of Administration" as proof of authority, per The Florida Bar. The Lee County Clerk of Court says a formal administration must be filed by a Florida-licensed attorney unless the personal representative is the sole beneficiary (Lee County Clerk, Probate, reviewed Oct. 2026).
Is there a faster option for smaller estates?
Possibly. Since July 1, 2026, Florida allows summary administration when the estate subject to administration, minus property exempt from creditors' claims, is $150,000 or less, or when the person has been deceased more than two years. The limit was $75,000 before Chapter 2026-57 (Florida Statutes s. 735.201, 2026; HB 1337). Some guides still list $75,000, so ask your attorney which route fits.
How long does probate take before I can sell?
The Florida Bar says even a simple estate stays open through the three-month creditor claim period, and a simple probate estate reasonably takes about five or six months. I can start pricing and prep work while the paperwork moves.
What happens to the homestead exemption?
The Florida Department of Revenue says the home will not receive the homestead exemption in the year after the owner's death, unless it continues for a surviving spouse or a qualifying joint tenant who lives there (Florida DOR FAQ, reviewed Oct. 2026). A change of ownership generally triggers reassessment at just value the following January 1, with certain exceptions for transfers upon death (DOR brochure PT-112). Heirs holding the home should budget for higher taxes.
Will I owe tax when I sell?
The IRS says your basis in inherited property is generally its fair market value on the date of death, and selling for more than your basis creates a taxable gain (IRS, Gifts and Inheritances, reviewed Oct. 2026). A documented date-of-death value matters.
What should I do first with the house?
- Secure it, and ask the insurance agent about coverage while it's vacant.
- Keep the power and A/C on, and keep up the pool and lawn.
- Gather the deed, tax bill, HOA details and any flood or wind mitigation reports.
FAQ
Can I list before probate is finished? The listing and sale must be signed by someone with authority, usually the personal representative. Ask the estate's attorney about timing.
Do all heirs have to agree? It depends on the will, the title and any court orders. That's a question for the attorney.
Do I have to fix up the home? No. Many inherited homes sell as-is. I'll show you the likely price both ways.
Does Florida have an inheritance tax? The Florida Bar says the estate has no tax filing obligations to the state. Federal rules may still apply.
