Do I Need a Seawall Inspection Before Selling a Gulf Access Home in SW Cape Coral in 2026?
No Florida law requires a seawall inspection to sell, but on Cape Coral Gulf-access and saltwater canal homes, city code puts seawall maintenance on the owner, the standard Florida seller disclosure asks whether the seawall and dockage are structurally sound, and much of a seawall is not readily observable — so many sellers get a marine or seawall look before listing. I'm Frank Glaab, P.A., a Realtor with Epique Realty in Cape Coral. This is general process information for Southwest Florida sellers, not legal advice.
Does Florida law require a seawall inspection to sell?
No. Florida sellers generally must disclose known facts that materially affect value and are not readily observable — the Johnson v. Davis framework. A seawall often fits that pattern: the face from the dock can look fine while panels, caps, tiebacks or settlement are harder to see without a closer look.
What does Cape Coral code require on Gulf access canals?
Cape Coral Land Development Code Sec. 5.4.8(A) (Ord. 51-19, Nov. 18, 2019) requires lots on saline, brackish or tidally influenced canal frontage to have a seawall along the full water frontage, built and structurally maintained at the owner's expense. Buyers shopping Cape Coral Gulf access homes and Southwest Cape Coral Gulf access homes ask about age, permits and condition, so knowing the wall's status before you list helps you disclose and price from known facts.
What does the Florida seller disclosure ask?
The Florida Realtors Sellers Property Disclosure – Residential (SPDR-4, 2025 form) asks: "Is seawall, if any, and dockage, if any, structurally sound?" A pre-listing marine or seawall visit is how many sellers gather that information — process preparation, not a legal requirement.
What if repairs need a City permit?
New or repair seawalls use a Marine Improvement Application. The City's residential seawall guideline (rev. June 22, 2020) calls for a site plan, specs (City engineering standards or signed/sealed engineer or architect plans), and DEP approval or SAJ-91 except on freshwater canals. That guideline lists a Seawall Residential fee of $110.25 and notes guidelines are subject to change — confirm current fees with the City. A replacement can run into the tens of thousands, another reason to know the wall's condition before you set a list price.
What should I do next?
Pull permits and the year built or last major work, consider a marine inspection before you list, check boat time with my Cape Coral boat time to the Gulf tool, and request a home evaluation. Browse Cape Coral homes for sale, read the 2027 Lee County flood map update, or see using a VA loan on a Gulf access home.
